Can NRIs buy property in India?

Yes. Under the Foreign Exchange Management Act (FEMA), Non-Resident Indians (NRIs), Overseas Citizens of India (OCIs) and Persons of Indian Origin (PIOs) can freely purchase residential and commercial property in India — no prior approval from the Reserve Bank of India is required. (Note: NRIs/OCIs generally cannot purchase agricultural land, plantation property or farmhouses.)

How payments work

Repatriation of funds

Subject to FEMA conditions, sale proceeds of residential property can be repatriated — generally limited to two residential properties, and to the amount originally remitted through proper channels for the purchase. Your bank or chartered accountant can confirm the specifics for your case.

Home loans for NRIs

Buying remotely — Power of Attorney

If you can't travel for registration, a properly executed Power of Attorney (PoA) in favour of a trusted person in India lets the purchase and registration proceed smoothly. We'll guide you on the correct, compliant process.

Valid passport (and OCI/PIO card where applicable) · PAN card · overseas & Indian address proof · passport-size photographs · and, for remote registration, a duly executed Power of Attorney.
